Ukraine Info: Holders of Temporary Protection temporarily returning to Ukraine
We have been receiving several queries regarding the situation of Temporary Protection holders and the possibility for them to return to Ukraine.
In most cases, these returns were linked to the need to sustain family members who were forced to remain in Ukraine, to provide humanitarian support, or to recover personal belongings left behind.
The Malta Refugee Council sent a formal info request to the International Protection Agency, and this is the reply we received:
“Kindly be informed that return to Ukraine, irrespective of its duration and the reason behind it, will lead to the withdrawal of TP status in Malta.
This is without prejudice to the possibility for the person concerned to travel back to Malta, subject to meeting the necessary travel requirements, and once again request TP.”
In view of this information, we must warn TP holders about the risk of returning to Ukraine. Anyone requiring in-depth legal advice is invited to consult our members.
